Terms and Conditions (GTC)

The following general terms and conditions initially concern all services of warescale network in section 1 (general scope).

Section 2 sets out the general terms and conditions that apply in particular to the internet services we offer.

1 right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded.

In order to exercise your right of withdrawal, you must contact us at warescale network, Westring 109, D-47574 Goch, phone: +49 2823 87897 50, fax: +49 2823 8789 7 51 by means of a clear statement (e.g. by fax or email) Decide to cancel this contract.

1.2 Consequences of cancellation

If you revoke this contract, all payments that we have received from you will be repaid immediately and at the latest within fourteen days from the day on which we received notification of your revocation of this contract. Unless otherwise agreed, we use the same method of payment for the repayment that you used when ordering.

When providing services

If the services begin during the cancellation period, you have to pay us a reasonable amount, which is the proportion of the services already provided by the time you inform us of the exercise of the right of cancellation with regard to this contract, compared to the total scope of the contract provided services.

2 validity

2.1 These general terms and conditions apply to all services of the company warescale network. Warescale network provides its services exclusively on the basis of these terms and conditions. Conflicting terms and conditions of a customer only apply if they are expressly recognized by warescale network.

2.2 These terms and conditions can only be changed by written agreement. Any changes or side agreements to the contract require written confirmation to be effective. This also applies to the withdrawal of the written form.

3 Offer, conclusion of contract, prices

3.1 An order with us only comes into being after we have confirmed it in writing. The customer is obliged to provide all the data required for the execution of the contract correctly and in full.

3.2 We are bound to prices and the content of offers for four weeks. After this time, price changes are reserved. Additional services that go beyond the content of the offer are to be paid for separately.

3.3 Our prices include the applicable statutory value added tax.

4. Terms of payment

4.1 The current prices apply, which can be viewed at https://www.warescale.com.

4.2 Depending on the contractual agreement, monthly or annual billing takes place. If the payment is due monthly, payment is only made by direct debit, bank transfer, credit card or PayPal. Fees are due for payment immediately after receipt of the invoice.

4.3 If the payment deadlines are exceeded, we are entitled to charge default interest even without a reminder. For a consumer, the amount of the default interest is 5 percentage points above the base rate. For an entrepreneur 8 percentage points above the base rate.

4.4 We are also entitled to block the customer’s services in the event of default and to withhold all other services.

4.5 Invoices are sent via email as an attachment. We are entitled to charge a reasonable processing fee for the delivery of invoices by letter.

5 Retention of title

We reserve the ownership of hardware sold by us until full payment.

6 Offsetting

The customer can only offset against claims by warescale network with undisputed or legally binding counterclaims.

7 defects

The customer is obliged to report obvious defects in our services immediately, i.e. to complain to us in writing without culpable hesitation, at the latest within a period of 1 week after delivery / service.

8 liability

8.1 warescale network is only liable for damage in the event of intent and gross negligence. In the event of a breach of an essential contractual obligation, warescale network’s liability is limited to the typical damage that was reasonably foreseeable when the contract was concluded, unless the breach of duty was deliberate or grossly negligent. This limitation does not apply to injury to life, limb and or or health as well as liability in accordance with the Product Liability Act.

8.2 In any case, liability for services is limited to the annual fee of the contractually agreed services.

9 Data protection

9.1 Our data protection practice complies with the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG).

9.2 Personal data of the customer are only collected and used if they are necessary for the establishment, content or change of the contractual relationship. The customer undertakes to keep this data up to date in his online administration area.

9.3 We only use the customer’s e-mail address for informational letters about the orders, for invoices and, if the customer does not object, for customer care and, if requested by the customer, for our own newsletter.

9.4 We do not pass on personal customer data to third parties. Service partners are exempted from this insofar as this is necessary for determining the fee and for billing with the customer.

9.5 The customer has the right to information and the right to correct, block and delete the stored data. If deletion is contrary to legal or contractual retention requirements or other legal reasons, the data will be blocked.

10 place of jurisdiction

If a contract is concluded between us and the customer as a merchant or legal entity, the exclusive place of jurisdiction for all legal disputes is Goch.

Section 2

11 termination

11.1 The termination and term of the contracts are based on the agreed duration and services, such as Colocation services, hire purchase options or the like. It begins on the day of the operational provision of the services.

11.2 Terminations must always be received in writing by warescale network in writing, by letter, fax, or email.

11.3 Unless a notice period is expressly specified, the notice of cancellation can be given 3 months before the minimum contract term expires, whereby the receipt of the notice by us is decisive.

11.4 If there is no cancellation or a late cancellation, the contract is automatically extended by the agreed minimum term.

11.5 Both parties reserve the right to terminate the contract without notice for an important reason. An important reason is, in particular, the opening of insolvency proceedings against the customer’s assets or late payment for current payment obligations over a period of more than two months or with an amount corresponding to the amount of two monthly fees. In the event of termination due to late payment, warescale network is entitled to block its services with immediate effect.

11.6 In the event of termination without notice, all existing claims against the customer on the part of warescale network are due with immediate effect.

12 Warranty

In any case, we are entitled to report justified defects in good time to correct them at our own expense.

13 faults

13.1 Faults or technical problems such as Network failures caused by third parties and preventing us from performing the agreed services release us from the performance towards the customer. In this case, claims for damages by the customer, insofar as damage was not caused intentionally or through gross negligence, against us within the scope of ß6.

13.2 The customer is not entitled to liability for indirect damage and consequential damage as well as loss of profit, except in the case of intent or gross negligence on our part.

13 Third party rights, obligations and liability of the customer

13.1 The customer warrants that prior to ordering a domain name, he has made inquiries at his own expense that the desired domain name does not violate any third-party rights in terms of copyright, trademark law or other legal considerations. The customer is obliged to indemnify us from any damage caused by warescale network’s claims for such violations.

13.2 The customer is solely responsible for ensuring that legal regulations and official requirements for the operation of his domain are met.

13.3 We reserve the right to block the customer’s domain with immediate effect if the content of the domain leads to legal violations or violations of the legal system. This applies in particular to the violation of trademark rights, copyright, criminal law and other legal provisions.

13.4 The customer is also liable for references on his domain to other content on the Internet. The customer has to ensure that the content of the linked pages does not violate applicable law.

13.5 The customer is not permitted to leave the use of the services agreed between him and us to anonymous third parties. Should we become aware of this, we reserve the right to block the services and to terminate the contract without notice.

13.6 The customer warrants that he does not offer any domains or content that contains erotic, pornographic, terrorist or extremist content. If the customer offers such content, we reserve the right to block the domain and terminate the contract without notice.

14 Operational safety

14.1 We also reserve the right to block the domain if its content can or will impair the operation of our server. This applies in particular to the operational security of our server.

14.2 The customer is liable to warescale network for ensuring that the data and operating systems used by him do not pose any security risks and that they do not impair or overload the operation of the warescale network server. The customer of warescale network must compensate for any damage resulting from this.

14.3 The customer is obliged to inform warescale network immediately if he detects the beginning of disruptions or risks.

16.4 If the customer cannot be reached by warescale network due to incorrect or not up-to-date contact details, warescale network reserves the right to terminate the contract without notice.

15 Data backup

15.1 The customer is responsible for securing his data unless otherwise agreed beforehand. Warescale network is not liable for data loss. In the event of data loss, the customer is obliged to make the data available again free of charge.

15.2 The customer undertakes to keep the passwords and other access data assigned to him secret and to store them carefully. The warescale network company is not liable for misuse of the customer’s access data and damage caused thereby, except in the event of intent or gross negligence on the part of the warescale network company.

If the customer alone has the administration rights of the server he is using, he is solely responsible for its security. In this case, the customer is also responsible for ensuring that the operational security of data and other servers is not jeopardized. Otherwise we reserve the right to block this server or to terminate the existing contractual relationship without notice.

We are happy to give students an insight into one of the warescale network’s IT departments. These internships mainly take place in user support and on our IT hotline.

Network Operations Engineer (m / f / d)

Your tasks

  • As a network system engineer, you configure routers, switches and firewall systems from different manufacturers.
  • They develop new configurations for these systems by further developing existing system configurations to ensure that our systems are always up to date.
  • A trouble-free data network is the be-all and end-all. They support us in localizing faults and correct them in cooperation with our field service.
  • You test new devices and firmware and then release them for operation.

What we expect

  • Extensive knowledge of network technology (ISO / OSI model, TCP / IP, IP routing, BGP, OSPF, CIDR notation, VPN)
  • Ideally experience with common network products from Cisco / Juniper, as well as experience in dealing with network tools (Wireshark / TCPDump, IPtables, iPerf, mtr, SNMP)

IT-Praktika für Schüler (w/m/d)

Sehr gerne ermöglichen wir Schüler*innen einen Einblick in eine der IT-Abteilungen der warescale network. Schwerpunktmäßig finden diese Praktika im Benutzer-Support und bei unserer IT-Hotline statt.

Durch die Begleitung und Unterstützung unserer IT-Service-Fachkräfte erleben Sie vielfältige Aufgaben rund um den Aufbau und die Konfiguration einfacher und komplexer IT-Systeme.

Network Operations Engineer (w/m/d)

Ihre Aufgaben

  • Als network System Engineer konfigurieren Sie Router, Switches und Firewall-Systeme unterschiedlicher Hersteller.
  • Sie entwickeln für diese Systeme neue Konfigurationen sorgen durch die Weiterentwicklung bestehender Systemkonfigurationen dafür, dass unsere Systeme immer auf dem neuesten Stand sind.
